Why Repeal Chapter 188 - Abortion thru 9 months?

Until Chapter 188, Massachusetts generally limited abortion after 24 weeks to four situations: to save the mother’s life, to protect her physical or mental health, a lethal fetal anomaly, or a grave diagnosis incompatible with sustained life outside the womb without extraordinary intervention. Those abortions also had to be done in a hospital, except in an emergency. Chapter 188, signed August 10, 2026, struck those four conditions. After 24 weeks, the statute now says an abortion may be performed “based upon the professional judgment of the physician.” It also dropped the hospital-only rule and the old medical-review check. The campaign’s view is that this is abortion through nine months with no statutory limit tied to the baby’s viability or the mother’s medical crisis.
